Terms of Use

These are the terms of use for duna, an iPhone and Mac app published by Oriol O'Callaghan. Downloading or using the app means accepting them.

The licence to use the app is Apple's: duna is supplied under Apple's standard Licensed Application End User License Agreement, which is the end user licence agreement (EULA) for this app. The terms on this page sit alongside it and cover what the standard agreement does not: what the app does, its limits, and your rights and obligations. Where anything here disagrees with Apple's standard agreement about the licence itself, Apple's wording wins.

What the app does

duna turns what the microphone hears into text, live, and makes subtitles for the videos and recordings you give it. All of it happens on your device. The languages (Catalan, Spanish, English, Galician and Basque) are downloaded one by one from Apple's servers when you ask for them; the app shows their size before downloading.

Free

duna is free. It has no in-app purchases, no subscriptions, no ads and no accounts.

Automatic transcription makes mistakes

duna is an automatic transcription, and it gets things wrong. It can mishear words, names, numbers or punctuation, and does so more often with background noise, with several people talking at once, far from the microphone, or with unusual accents and vocabulary. Galician and Basque are marked New: they are the most recent and make more mistakes still.

duna is not a medical device or a hearing aid, and it does not replace a professional captioning or interpreting service, or any prescribed assistive device. Do not rely on it where a mistake could have serious consequences: emergencies, safety announcements, medical or legal information, or any situation in which you need an exact transcript. In those cases, always confirm by another means.

The people you transcribe

When you use duna you are transcribing other people's voices. Respect their privacy and follow the law where you are: where needed, tell them or ask their permission, especially before saving or sharing what they said. You are responsible for what you do with the text.

Your videos and recordings

You must have the right to use the videos and recordings you open in duna. Making subtitles for them gives you no right you did not already have, and what you do with them is yours to answer for. We never see your files, so we cannot police this and do not try to.

Privacy

duna collects nothing and sends nothing anywhere. The Privacy Policy says so in full, and forms part of these terms.

Third-party components

duna uses third-party models and software, each under its own licence. The corresponding notices are also inside the app, on its information screen.

The models have been converted to the format the app uses and compressed (quantised); the Catalan and Basque punctuation models were trained for duna from the base models listed. None of these authors endorses duna.

What we do not promise

duna is provided as it is. No particular accuracy, speed or availability is guaranteed, nor that the app is free of faults or will keep working after an operating system update. The languages depend on Apple's servers for their first download.

As far as the law allows, we are not liable for loss of data, loss of profit, or other indirect or consequential loss arising from use of the app. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are untouched by these terms.

Acceptable use

Do not decompile, reverse engineer or redistribute the app or the models inside it beyond what the law and the relevant licences permit. Do not use duna to record or monitor anyone in a way the law forbids.

Apple's position in all this

duna is distributed through the App Store. The points below are already part of Apple's standard licence agreement, and are repeated here so that everything you need is on one page.

This agreement is with us, not with Apple

These terms are between you and Oriol O'Callaghan alone. Apple is not a party to them. We, not Apple, are solely responsible for duna and its content.

Scope of the licence

Apple's standard agreement grants you a non-transferable licence to use duna on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.

Maintenance and support

We are solely responsible for any maintenance and support for duna. Apple has no obligation whatsoever to provide any maintenance or support services for it.

Warranty

We are solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If duna fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you; duna is free, so that price is zero. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.

Product claims

We, not Apple, are responsible for addressing any claims from you or any third party relating to duna or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

Intellectual property

If a third party claims that duna, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.

Legal compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms

You must comply with any applicable third-party terms of agreement when using duna.

Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of them, Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

Changes to these terms

These terms may change. The current version is always the one on this page, with its effective date. Continuing to use the app after a change means accepting the new version.

Governing law

These terms are governed by the laws of Spain. If you are a consumer, you keep the protection of the mandatory rules of the country you live in.
